Terms, Returns & Refunds Policy

Welcome to emmanuelwaldron.com. By accessing, browsing, or purchasing from this website, you agree to be bound by the following Terms and Conditions. Please read them carefully before using our services.

1. General Information
– This website is operated by Emmanuel Waldron.
– “We”, “our”, and “us” refer to Emmanuel Waldron. “You” and “your” refer to the customer, visitor, or user.
– We reserve the right to update or amend these Terms at any time. Changes will take effect immediately upon posting on this website.

2. Services Offered
We provide a range of services and products including:
– Learn – Online piano and keyboard lessons.
– Consult – Creative and performance consultations.
– Create – Custom backing tracks and music production.
– Perform – Live music performances for events and private functions.
– Digital Products – Downloadable backing tracks, lesson materials, and music resources.
– Physical Products – Books, merchandise, or other tangible items (where offered).

3. Bookings & Payments
– All lesson bookings, consultations, and performances must be paid for in advance.
– Prices are displayed in GBP and include VAT where applicable.
– We reserve the right to change prices at any time but confirmed bookings and purchases will not be affected.
– Payments are processed securely through our third-party payment provider. We do not store card details.
– Deposits are non-refundable except where cancellation is solely due to our fault.

4. Client Responsibilities & Delays
– You are responsible for providing all necessary information, materials, and approvals required for us to deliver services (e.g. track details, set lists, creative direction).
– Timeframes for delivery will only begin once all required information has been provided.
– Timeframes are provided in good faith as estimates only and time shall not be of the essence in these Terms.
– If you delay in providing information, materials, or responses, this may extend delivery times. We are not liable for missed deadlines caused by your delay.
– Where delays exceed 30 days, we reserve the right to close the project and retain any payments made to date.

5. Cancellations & Rescheduling
Piano Lessons & Consultations
– Cancellations must be made at least 24 hours in advance to reschedule without charge.
– Missed sessions or late cancellations (less than 24 hours) will be charged in full.
– Lesson packages must be used within 6 months of purchase and are non-transferable.
– Completed services (such as lessons or consultations already delivered) are non-refundable.
– If we cancel a lesson, we will reschedule or refund at our discretion.

Performances (Events & Functions)
– A non-refundable deposit (amount confirmed at booking) is required to secure a date.
– Balance payments are due no later than 14 days before the event.
– Cancellations made more than 30 days before the event: deposit retained, no further payment due.
– Cancellations made less than 30 days before the event: full balance remains payable.

6. Force Majeure
– We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control.
– This includes (but is not limited to) illness, accidents, travel disruption, strikes, industrial disputes, natural disasters, fire, flood, epidemic, pandemic, government restrictions, power outages, internet or hosting failures, or acts of God.
– In such circumstances, we will make reasonable efforts to reschedule or provide an alternative solution. If this is not possible, liability is limited to a refund of amounts already paid for the affected service.

7. Digital Products
– All digital product sales are final. We do not issue refunds once an order is confirmed and the files are delivered.
– By purchasing, you acknowledge and agree to lose your statutory 14-day cancellation right once the digital content is downloaded or accessed.
– If you experience issues downloading or accessing your digital product, please contact us for assistance.
– Digital purchases are for personal use only and must not be shared, resold, or redistributed. Backing tracks are licensed for personal use and live performance only. Recording, distribution, or broadcast requires a separate licence.

8. Physical Products & Returns
We offer refunds on physical products provided that:
– It has been less than 28 days since you received your item.
– The product is in resalable condition (tags attached, unopened packaging, no marks/damage).
– You have valid proof of purchase (receipt, order confirmation, delivery note).
– You pay for return postage (we do not refund delivery charges).

Refunds will be issued once the item is received and condition verified. Please allow up to 14 days for processing to the original payment method.

This does not affect your statutory rights to a refund or replacement for faulty or misdescribed goods under the Consumer Rights Act 2015.

9. Services During the 14-Day Cooling-Off Period
– When you purchase lessons, consultations, or performance services online, you have a statutory 14-day cancellation right.
– By booking a service to take place within this period, you agree that:
  – We may begin providing the service immediately.
  – If the service is completed within the 14-day period, you lose your right to cancel.
  – If you cancel after work has begun but before completion, we will refund you proportionally for any unperformed part of the service and retain payment for work already carried out.

10. Intellectual Property & Licensing
– All content on this site (music, text, images, recordings, videos, digital downloads) is the intellectual property of Emmanuel Waldron unless otherwise stated.
– Purchases grant a non-exclusive, non-transferable licence for personal use only, unless otherwise agreed in writing.
– You may not copy, reproduce, distribute, or exploit any content without prior written permission.

11. Limitation of Liability
– Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
– We are not responsible for indirect, incidental, or consequential damages arising from the use of our services or products.
– While we make every effort to ensure accuracy, we do not guarantee uninterrupted access or error-free content on this website.
– Our liability for any claim shall be limited to the amount paid for the relevant product or service.

12. Privacy & Data Protection
– We respect your privacy and handle personal data in accordance with GDPR.
– Information collected is used solely for processing orders, bookings, and communication.

13. Governing Law & Jurisdiction
